Directive 2011/51/EU (Amending 2003/109/EC)

Directive 2011/51/EU of the European Parliament and of the Council of 11 May 2011 amending Council Directive 2003/109/EC to extend its scope to beneficiaries of international protection [COM 2007/0112; COD 2007/0112; Date of transposition 20 May 2013]

Legal basis = in particular Article 79(2)(a) and (b) TFEU
For the purposes of paragraph 1, the European Parliament and the Council, acting in accordance with the ordinary legislative procedure, shall adopt measures in the following areas:
(a) the conditions of entry and residence, and standards on the issue by Member States of long-term visas and residence permits, including those for the purpose of family reunification;
(b) the definition of the rights of third-country nationals residing legally in a Member State, including the conditions governing freedom of movement and of residence in other Member States;

Regulation 1987/2006 SIS II

62(2)(a): The Council, acting in accordance with the procedure referred to in Article 67, shall, within a period of five years after the entry into force of the Treaty of Amsterdam, adopt > measures on the crossing of the external borders of the Member States which shall establish > a standards and procedures to be followed by Member States in carrying out checks on persons at such borders
63(3)(b): The Council, acting in accordance with the procedure referred to in Article 67, shall, within a period of five years after the entry into force of the Treaty of Amsterdam, adopt > measures on immigration policy within the following areas > illegal immigration and illegal residence, including repatriation of illegal residents
66: The Council, acting in accordance with the procedure referred to in Article 67, shall take measures to ensure cooperation between the relevant departments of the administrations of the Member States in the areas covered by this title, as well as between those departments and the Commission

Recast Qualification Directive 2011/95/EU

Directive 2011/95/EU of the European Parliament and of the Council of 13 December 2011 on standards for the qualification of third-country nationals or stateless persons as beneficiaries of international protection, for a uniform status for refugees or for persons eligible for subsidiary protection, and for the content of the protection granted [2009/551(COM); 2009/0164(COD); Date of transposition 21 December 2013]

Legal basis = in particular points (a) and (b) of Article 78(2) TFEU
1. The Union shall develop a common policy on asylum, subsidiary protection and temporary  protection with a view to offering appropriate status to any third-country national requiring international protection and ensuring compliance with the principle of non-refoulement. This policy  must be in accordance with the Geneva Convention of 28 July 1951 and the Protocol of 31 January  1967 relating to the status of refugees, and other relevant treaties.
2. For the purposes of paragraph 1, the European Parliament and the Council, acting in accordance with the ordinary legislative procedure, shall adopt measures for a common European asylum system comprising:
(a) a uniform status of asylum for nationals of third countries, valid throughout the Union;
(b) a uniform status of subsidiary protection for nationals of third countries who, without obtaining
European asylum, are in need of international protection;
